What Other Persons are Eligible for Workers Compensation in Virginia?

 

The Virginia Workers Compensation Act allows for the payment of workers compensation benefits to certain non-employees. Mr. Pollard can help if you fall within one of the following categories:

 

Dependents

 

A dependent spouse (wife or husband), child, or parent may receive workers compensation benefits when the employee dies in a workplace accident or because of a consequence of the initial injury by accident or occupational disease.

 

The dependent seeking temporary total disability benefits, burial expenses, or a lump sum settlement has the burden of proving that he or she was dependent on the deceased worker. Certain classes of individuals, such as minor children and spouses who lived with the deceased employee at the time of death, are presumed dependent on the employee.

Aliens/Illegal Immigrants/Undocumented Workers

 

In the past an undocumented worker or illegal alien was not considered an “employee” under the Virginia Workers Compensation Act. The rationale behind this rule was that because an illegal alien cannot be lawfully employed under the Immigration and Reform and Control Act, an illegal alien could not be an “employee.” Employers, therefore, benefited from the labor of undocumented workers but did not have to pay workers comp benefits when those same workers were hurt on the job.

 

In 1999 the Supreme Court of Virginia decided Granados v. Windson Development Corp., 257 Va. 103 (1999). That decision, criticized by many, upheld the denial of workers compensation benefits to a claimant who was an illegal alien.

 

The Virginia General Assembly took action following the Granados decision. It amended the Workers Compensation Act to include undocumented workers and lawfully employed alien workers, such as those in the United States on a visa or green card. There are still limits on the kind of wage loss benefits an undocumented worker is entitled to; however, lifetime medical treatment is available so long as the illegal alien proves a compensable injury by accident.

 

Employees of Subcontractors Not Eligible for Workers Compensation

 

In Virginia an employer is not required to have workers compensation coverage if it employs two or fewer employees. There are many small businesses in the construction industry with two or fewer employees.

 

If a person is employed by a subcontractor that is not required to have workers compensation insurance or does not have it even though it is supposed to, workmans comp benefits may still be available. The question is whether the subcontractor’s employee is a “statutory employee” of the general contractor managing the job.

 

A general contractor is considered the statutory employer of a subcontractor’s injured employee if the employee is engaged in the general contractor’s trade, business, or occupation at the time of the injury. In our experience the Workers Compensation Commission views this definition broadly. Most tasks performed by subcontractors, especially those in the electrical, plumbing, and HVAC fields, fall within the general contractor’s trade, business, or occupation because they are key components of building a structure.

 

This broad definition is not necessarily a good thing. If the Commission finds an injured employee is a statutory employee then the injured worker may not bring a personal injury action against his actual employer – the subcontractor.
